Brasserie Kaiser & Entresol
1. General
These General Terms and Conditions (GTC) govern the legal relationship between the
guest, customer or organiser (hereinafter the «Guest») and Kaiser Grundversorgung AG
as operator of the Brasserie Kaiser and the Entresol (hereinafter the «Restaurant»).
For the sake of simplicity, these GTC – irrespective of the type of service – always refer to
a «Contract».
Only the General Terms and Conditions in force at the time the Contract is concluded shall
apply.
Should individual provisions of these GTC be or become wholly or partially invalid,
the validity of the remaining provisions shall remain unaffected. The statutory
provisions shall apply.
2. Place of Jurisdiction / Applicable Law
The place of jurisdiction for all disputes arising from this contractual relationship is Bern, provided
that no mandatory statutory place of jurisdiction applies.
Swiss law applies exclusively.
The place of performance and payment is Bern.
3. Definitions
Groups
Reservations for eight (8) or more persons are deemed to be groups.
Written Confirmations
E-mails are also deemed to be written confirmations.
Contracting Parties
The contracting parties are the Guest and Kaiser Grundversorgung AG.
4. Subject Matter of the Contract / Scope
The contract for the reservation of tables, premises and other services
comes into effect upon the Restaurant’s written confirmation or, in the case of online bookings,
upon the reservation confirmation.
Reservations made on the day of the event and accepted by the Restaurant
are deemed to be binding with immediate effect.
Amendments to the contract become binding only upon the Restaurant’s written
confirmation.
Unilateral amendments by the Guest are invalid.
5. Scope of Services
The scope of services is governed by the confirmed reservation.
The Guest has no claim to a particular table or room.
Should no corresponding table or room be available despite a confirmed reservation,
the Restaurant shall inform the Guest without delay and endeavour to provide an equivalent
solution.
6. Prices / Obligation to Pay
All prices are quoted in Swiss francs (CHF) including statutory
value added tax.
The Guest undertakes to pay for all services received at the agreed or applicable
price.
This also applies to services received by accompanying persons or guests of the
organiser.
Statutory increases in levies after conclusion of the contract shall be borne by the Guest.
Published prices may be adjusted at any time. The prices confirmed by the Restaurant
shall be decisive.
The Restaurant may require a deposit or a credit card guarantee.
In the event of late payment, the Restaurant may withdraw from the contract and charge any
cancellation costs in accordance with the quotation.
The Restaurant is entitled to issue interim invoices.
The final invoice may be settled in cash or by the accepted means of payment.
7. Events / Group Reservations
A group reservation or event may include catering, room hire, technical
infrastructure and other agreed services.
Number of Participants
The definitive number of participants must be communicated to the Restaurant no later than three working days before the
event.
The agreed cancellation conditions apply to any subsequent changes.
